These “Terms of Service” govern the services provided by Sortitt and your access and use of the services provided by Sortitt through its website, mobile application, or any other medium agreed between Sortitt and a user.

Sortitt is referred here to as “Sortitt”, “we”, or “us” whereas “you” or “user” means you as a user of the services offered by Sortitt.

It is your responsibility to read through these terms of service carefully before you start using the site or services offered by Sortitt. By using the site, opening an account, using the platform or procuring any services offered by Sortitt, you are agreeing to be bound by these Terms of Service and any additional terms or policies published by Sortitt (collectively, the “Terms”) which are incorporated herein by reference.

Furthermore, you acknowledge that you have read and understood our Privacy Policy and confirm your compliance.

If you do not agree to these Terms or Sortitt’s privacy policy, you must not access of use any services offered by Sortitt including using Sortitt’s website.

This site and any services offered by Sortitt are for users that are 18 years of age or older. If you are under 18 years old you require parental consent to utilize these services. You may not use the service if you are 13 or under. You cannot use this site or services offered if you are subject to any economic sanctions or trade restrictions imposed by any applicable jurisdiction.

Definitions  

Freelancer: are users who offer and perform services through jobs/services

Client: are users who purchase services on Sortitt

Jobs/Services: are services offered on Sortitt

Applicable Law: England and Wales

Assessments: are the written/verbal test of skill and suitability a freelancer undergoes as part of the on the boarding process

Custom Order: are requests made by a client to receive a custom offer from a freelancer

Order(s): are the formal agreements between a client and freelancer after a purchase is made by the freelancer

Platform: web application in which clients and freelancers will communicate and procure services through

 

  1. Overview-

To buy and sell on Sortitt you need to be a registered user. You can register using the website and registering for an account. You must provide your accurate and complete details as requested. You must not create an account for misleading or fraudulent purposes.

You acknowledge that you are responsible for any activity conducted via your account and you solely are responsible for your account details including any security related details such as your password.

Services are offered at various starting prices and a freelancer may determine their own price. Sortitt may determine a minimum base starting price at its discretion.

A client must pay Sortitt in advance to proceed with an order and freelancers must fulfill their orders in accordance with the standards mutually agreed between a client and freelancer.

Freelancers will have a rating based on the assessment, their performance (i.e. cancellation of jobs) and reviews provided by clients.

Users must not offer or take payments in any method other than via Sortitt.

Once a freelancer has completed an order all rights for the delivered work as part of the order belong to the client unless otherwise specified by the freelancer.

Sortitt may use the delivered work for marketing, promotional and publicity purposes at its sole discretion. Users may withdraw their consent by emailing [email protected].

 

  1. Freelancers

Interested freelancers will undergo an assessment when registering as a freelancer on the website. This assessment will determine whether an interested freelancer can register as a freelancer. We will use the assessment results to provide a rating to the freelancer which will be displayed on their profile and be visible to clients. Freelancers will also receive a rating based on reviews by clients which will be (the rating and review) available to all or potential clients. Sortitt may remove a rating or review at its sole discretion. Low ratings by clients may lead to suspension of a freelancers account, at Sortitt’s discretion.

Freelancers create jobs on Sortitt which clients can purchase. Freelancers retain 85% of purchase amount which is paid by Sortitt once a freelancer has completed the job. Sortitt charges an additional 3% fee on total cost of the services.

A freelancer must only provide services that comply with the laws and regulations of the Applicable Law. Sortitt reserves the right to request for any documentation to ensure your compliance with the Applicable Law.

Freelancers warrant that any content included in their job is original work conceived by the freelancer and does not infringe any third party rights, including, without limitation, copyrights, trademarks or service marks. In the event that certain music or stock-footage media are incorporated within the job, freelancers represent and warrant that they hold a valid license to use such music and/or footage and to include them in the Job.

 

  1. Jobs

Freelancers will post jobs on the website and such jobs are considered to be User Generated Content (UGC). UGC is content uploaded by users directly including clients and freelancers. Each user is responsible for the content that they upload and Sortitt does not check UGC for appropriateness, violations of copyright, trademarks or other violations. By uploading to, or creating content on, the website, you represent and warrant that you own or have obtained all rights, licenses, consents, permissions, power and/or authority, necessary to use and/or upload such content and that such content or the use thereof in the website does not and shall not (a) infringe or violate any intellectual property, proprietary or privacy, data protection or publicity rights of any third party; (b) violate any applicable local, state, federal and international laws, regulations and conventions; and/or (c) violate any of your or third party’s policies and/or terms of service. Sortitt is not responsible for the content, quality or the level of service offered or provided by the freelancers. Sortitt offers no warranty relating to the jobs, their delivery, and any communications or guaranteed between clients and freelancers. If a job is offered by a freelancer to a client, the freelancer has agreed that they have the required permissions, rights, and licenses to provide the job offered.

Users may not upload statements that contradict or violate these terms. We may remove UGC from Sortitt’s website for violations of these terms and user accounts may be suspended or removed. If a job or user has been permanently removed for violations, they must not be restored or attempted to be reuploaded. We may also remove jobs due to poor performance or misconduct.

If a client purchases a job where the finished product will be a physical good such a product will need to be shipped to the client. Freelancers may determine their own shipping price which should be incorporated in their final price offering. A client will have to provide their shipping address in order to fulfill the order, and freelancers and clients are responsible for arranging the delivery of the finished physical product. Sortitt does not handle or guarantee shipping, tracking, quality and condition of items or their delivery. Sortitt shall not be responsible or liable for any damages or other issues resulting from shipping. Freelancers must share a tracking number with clients if shipping a physical good.

 

  1. Clients

Clients may not offer direct payments to freelancers and must purchase and pay only via Sortitt’s website. Sortitt may use the delivered work for marketing and promotion purposes provided the user has agreed for such publication.

You must never use funds that were obtained illegally or by violating an applicable law.

We may personalise recommendations to you of certain products or freelancers to improve your experience.

 

  1. Orders and Payment

Users can communicate through the website before and after placing an order and once a job has begun. At no point shall users communicate in any means other than through mechanisms provided through the website. For terms governing the use of the chat feature see section 6 of these terms.

Once a payment has been received from a client, you will receive a confirmation of your order.

The delivery of your work (that is not a physical good) will be delivered through our platform.  

Once a job has been delivered, a client will have 3 days to review the work and accept it to be completed. If no response is received from a client within 3 days of delivery the job will be marked as completed.

If users agree to meet in person that should be at their discretion entirely. Sortitt is not responsible for the behavior, action, safety, suitability or anything else associated with an in person meet of a user and shall not be held liable for the same.

When a client requests a job, the freelancer(s) will receive a notification on the platform if logged into their account. 

Freelancers are required to meet the delivery time they specified when accepting the job. Failing to do so may allow the client to cancel their order. When an order is marked as late, it may harm the freelancer’s rating.

Freelancers agree to send completed files using the platform and clients agree to send any supporting documentation through the platform.

Users are responsible for scanning all transferred files for viruses and malware. We will not be held responsible for any damages which might occur due to site usage, use of content or files transferred.

Clients have the right to request revisions to their delivered good through the platform even if the item is marked as delivered if the delivered good does not match the freelancer’s description or does not match the requirements sent to the freelancer.

Clients will make the full payment at the time of placing the order via PayPal.

Freelancers retain 85% of purchase amount which is paid by Sortitt within 7 days of freelancers completing a job. Sortitt charges an additional 3% fee on total cost of the services.

 

  1. Chat Feature

The website provides a chat feature to facilitate communication between freelancers and clients. All interactions, communications, and transactions conducted through the chat feature are solely between the freelancers and clients. We do not monitor, control, or endorse the content exchanged between . Users are solely responsible for their conduct and the content they share in the chat. Sortitt is not liable for any disputes, claims, losses, injuries, or damages of any kind arising out of or in connection with the interactions between freelancers and clients.

Sortitt makes no representations or warranties regarding the reliability, accuracy, completeness, or legality of any information exchanged through the chat feature. Users acknowledge that any reliance on such information is at their own risk.

We shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of the chat feature, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.

While the Sortitt is not obligated to monitor the chat interactions, it reserves the right to do so at its discretion and may remove any content that it deems inappropriate, harmful, or in violation of these terms or applicable law.

 

  1. User Conduct

Users must always adhere to the conduct detailed here when using the website and obtaining services from Sortitt.

Requesting or providing email addresses, third party messaging applications, telephone numbers or any other personal contact details to communicate outside of Sortitt is not allowed. Any exchange of personal information must take place through Sortitt.

Sortitt does not provide protection for users if interacting outside of the website and all information and files exchanges must be performed only on the website.

Rude, abusive, improper language, violent or threatening messages will not be tolerated and may result in suspension or removal of your account.

Discrimination of any form is not tolerated and may result in suspension or removal of your account and users should not defame freelancers or clients in any manner.

Users may not use the platform for any other purpose than as prescribed here and as intended by Sortitt. Spamming or soliciting previous clients or freelancers to remove or modify a review will not be tolerated.

 

  1. Ownership

When purchasing a job on Sortitt unless clearly stated otherwise by the freelancer. When the work is delivered, and subject to payment, the client is granted all intellectual property rights, including but not limited to, copyright in the work delivered from the freelancer, and the freelancer waives any and all moral rights (to the extent permitted by applicable law) therein. The freelancer expressly assigns to the client the copyright in the delivered work and assigns all right, title and interest therein. All transfer and assignment of intellectual property to the client shall be subject to full payment for the job, and the delivery may not be used if payment is cancelled for any reason.

If you intend to use a work for a commercial purpose you may require additional licenses which are your responsibility to procure.

 

  1. Non-Permitted Usage

Users are prohibited to use the website or services for:

Adult Services and Pornography

Inappropriate Behavior & Language

Phishing and Spam

Fraud/Unlawful Use

Creating multiple accounts

Abuse and Scam

Privacy and Identity: You may not publish or post other people’s private and confidential information. Any exchange of personal information required for the completion of a service must be provided in through the website. Freelancers further confirm that whatever information they receive from the Client, which is not public domain, shall not be used for any purpose whatsoever other than for the delivery of the work to the Client. Any users who engage and communicate off of Sortitt will not be protected by our Terms of Service.

Authentic Profile: Users may not create a false identity, misrepresent your identity, create a fake profile or a profile for anyone other than you. Sortitt reserves the right to require Users to go through a verification process.

 

  1. Deactivate and Disable accounts

Sortitt may at its sole discretion deactivate or disable user accounts if it deems necessary for the purposes of its business or business security.

 

  1. Disputes and Cancellations

We encourage our clients and freelancers to try and settle conflicts amongst themselves.

For any disputes of the delivered goods clients should use the complaint feature offered via the platform or email at [email protected]. Sortitt will review and assess each complaint and determine the best course of action or compensation.

For the avoidance of doubt orders are not eligible to be cancelled based on the quality of service/materials delivered by the freelancer if the service was rendered as described.

 

  1. Feedback

If you provide Sortitt with any comments, suggestions or other feedback regarding the site, servicers, you will be deemed to have granted Sortitt an exclusive, royalty-free, fully paid up, perpetual, irrevocable, worldwide ownership rights in the feedback. Sortitt is under no obligation to implement any feedback it may receive from users.

 

  1. Confidentiality

Freelancers acknowledge that there might be a need for clients to disclose certain confidential information to be used by freelancers for the purpose of delivering the ordered work, and to protect such confidential information from unauthorized use and disclosure. Therefore, freelancers agree to treat any information received from clients as highly sensitive, top secret and classified material. Without derogating from the generality of the above, freelancers specifically agree to (i) maintain all such information in strict confidence; (ii) not disclose the information to any third parties; (iii) not use the information for any purpose except for delivering the ordered work; and (vi) not to copy or reproduce any of the information without the clients permission.

 

  1. Warranty

Your use of the site, its content and any services or items obtained through the site or platform is at your own risk. the site, its content and any services or items obtained through the site are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, provided that we have acted with reasonable professional diligence. Neither Fiverr nor any person associated with Sortitt makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy or availability of the site.

The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.

 

  1. Limitation on Liability

We will act with reasonable professional diligence and in no event will Sortitt, its affiliates or their licensors, service providers, employees, agents, officers or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the site, the platform,  any websites linked to it, any content on the site or such other websites or any services or items obtained through the site or such other websites, including any direct, indirect, special, incidental, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

The foregoing does not affect any liability which cannot be excluded or limited under applicable law.

The term “Affiliate” referred to herein, is an entity that, directly or indirectly, controls, or is under the control of, or is under common control with Sortitt, where control means having more than fifty percent (50%) voting stock or other ownership interest or the majority of voting rights of such entity.

 

  1. Changes

Sortitt may make changes to these Terms, when such changes are made these Terms will be updated. You understand and agree that if you use Sortitt after the date on which the Terms have changed, Sortitt will treat your use as acceptance of the updated Terms. If you do not agree to the changes of the Terms, you will have to deactivate your account.

 

  1. Indemnity

To the fullest extent possible pursuant to applicable law, you agree to defend, indemnify, and hold Sortitt harmless, including its officers, directors, or shareholders, employees, affiliates and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, debt and expenses (including attorneys’ fees) arising from: (1) your violation of any of these Terms or any other Sortitt Terms, policies and standards; (2) your violation of any third-party right, including any intellectual property right, access rights, property, or privacy right; and/or (3) any other type of claim that your job and/or your use of the website/platform or services caused to a third party, provided that Sortitt acts with reasonable professional diligence. Sortitt reserves the right to handle its legal defense however it deems fit—even if you are indemnifying Sortitt—in which case you agree to cooperate with Sortitt so it can execute its strategy.

 

  1. Severability

If any part of the terms and conditions agreement is found to be unenforceable, that part will be limited to the minimum extent necessary so that the terms will otherwise remain in full force and effect. Sortitt’s failure to enforce any part of the terms is not a waiver of its right to later enforce that or any other part of the terms.

 

  1. Entire Agreement

Our terms constitute the entire agreement concerning the subject matter therein, and supersede any other agreement regarding the site or services.
